1. Acceptance of these Terms of Use
1.1 By browsing or otherwise using the Site, you agree to these Terms of Use. If you do not agree, please do not use the Site.
1.2 We may update these Terms of Use from time to time by posting a revised version on this page with an updated "Last updated" date. Changes apply from the date they are posted and do not apply retrospectively to a dispute that arose before the change. If a change is material, we will take reasonable steps to bring it to the attention of registered account holders (for example, by email or an on-site notice).
2. Ownership of Site content
2.1 Unless otherwise indicated, all content on the Site (including text, graphics, logos, product images, and the layout and design of the Site) is owned by or licensed to Pakko and is protected by copyright, trade mark, and other intellectual property laws.
2.2 You may view, print, and download extracts from the Site for your own personal or internal business use (for example, to review a quote or product specification). You must not otherwise reproduce, republish, or commercially exploit Site content without our prior written consent.
3. Acceptable use
3.1 When using the Site, you must not: (a) breach any applicable law; (b) infringe the intellectual property or other rights of any person; (c) attempt to gain unauthorised access to the Site, our systems, or another user's account; (d) introduce any virus, malware, or other harmful code; (e) use automated means (such as scraping or bots) to extract data from the Site other than as permitted by our robots.txt file; or (f) interfere with the proper working of the Site.
3.2 We may suspend or restrict your access to the Site (including any account) if we reasonably believe you have breached this clause 3, without limiting any other right or remedy available to us.
4. Accounts
4.1 If you create an account on the Site, you must provide accurate information and keep it up to date. You are responsible for maintaining the confidentiality of your login details and for all activity that occurs under your account.
4.2 If you become aware of any unauthorised use of your account, please contact us at info@pakko.com.au as soon as possible.
4.3 We may suspend or close an account where we reasonably believe it is being used in breach of these Terms of Use, or where we are required to do so by law. Closing an account does not affect any order already placed under our Terms and Conditions.
5. Accuracy of Site content
5.1 We try to keep information on the Site, including product descriptions, images, pricing, and stock availability, accurate and up to date. However, the Site is not a contractual offer, and Site content is provided for general information only.
5.2 Occasionally, content on the Site (including a displayed price or stock status) may contain an error. If this happens in relation to an order you have placed, we will contact you as soon as reasonably possible to let you know, and you will be given the choice of confirming your order at the correct price or stock position, or cancelling it for a full refund. Nothing in this clause limits or excludes any right or remedy you have under the Australian Consumer Law, and we do not rely on this clause to avoid our obligation to take reasonable care in displaying accurate information.
6. Availability of the Site
6.1 We aim to keep the Site available and operating properly, but we do not guarantee uninterrupted or error-free access. The Site may be unavailable from time to time for maintenance, updates, or reasons outside our control. This clause does not limit any consumer guarantee that applies to services we supply to you under the Australian Consumer Law.
7. Third-party links
7.1 The Site may contain links to third-party websites (for example, our couriers, payment providers, or social media pages) for your convenience. We do not control and are not responsible for the content or privacy practices of those third-party websites. Linking to a third-party website does not imply our endorsement of it.
8. Liability
8.1 Nothing in these Terms of Use excludes, restricts, or modifies any guarantee, right, or remedy that cannot lawfully be excluded, restricted, or modified under the Australian Consumer Law or other applicable law, including the unfair contract terms provisions of the Australian Consumer Law where you are a small business.
8.2 To the extent the law permits, and subject to clause 8.1, we are not liable for any loss or damage arising from your use of, or inability to use, the Site, except to the extent that loss or damage is caused by our negligence or breach of these Terms of Use.
9. Australia-only supply
9.1 Pakko supplies products and services only within Australia. The Site may be viewed from outside Australia, but this does not mean we supply or deliver goods to overseas addresses — see our Terms and Conditions and Shipping Policy for details.
10. Governing law and disputes
10.1 These Terms of Use are governed by the laws of Queensland, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Queensland, without limiting your right, where you are a consumer, to bring a claim in the small claims tribunal or equivalent body of the State or Territory in which you reside.
10.2 If you have a concern about the Site or these Terms of Use, please contact us first at info@pakko.com.au so we can try to resolve it directly. This does not limit your right to make a complaint to a regulator or bring a claim in a court or tribunal of competent jurisdiction at any time.
